1What these terms cover
These terms are between Synura AI Solutions and the business that buys Bookingwell. They cover the build, the running booking page and admin, and any care plan the business is on. By using Bookingwell to take bookings, the business agrees to them.
Bookingwell is a one-time build. The business pays for the build, and the booking page then keeps working whether or not the business is on a care plan. This is not a monthly licence that switches off when a payment stops.
2What the business gets
A working booking page on the business's own address and brand, the script that embeds the same page into a website the business already has, the public API the booking page itself uses, and the admin for the day's schedule, the people the business sees, its services, hours and time off. What is built and what is still coming is described on the pricing page in plain terms, and where something is not ready we say so rather than implying it is.
While a business is on a care plan it gets support, changes, monitoring and updates. Stop the care plan and the booking page carries on exactly as it did the day before; what stops is the ongoing work, not the product.
3What is the business's responsibility
Bookingwell holds a business's customers' personal information, and the business is the one that decided to collect it. So a few things are the business's own responsibility, not ours:
- Its customers' data. Handling it lawfully, answering a customer who asks to see or delete their information (the tools to do both are in the product), and telling customers where the data is kept. Our privacy page gives the business the country list and the wording to do that.
- Its own professional obligations. Whatever a business's profession or trade requires of it, including keeping the records it is required to keep, remains the business's to meet. Bookingwell is a tool, not a compliance guarantee.
- Who reaches the account. Keeping the email inbox that the account signs in through secure, and controlling who has access to it. Today that inbox is the key to the account; the security page explains this and the second layer we are adding.
- The accuracy of what it publishes. Its services, prices, hours and any registration numbers shown to customers.
4Sending mail lawfully
Bookingwell sends confirmations, reminders, cancellations and receipts, and nothing else. There is no bulk email, no newsletter and no send-to-all feature, and this is deliberate: transactional messages a customer is expecting are low risk under Canada's anti-spam law, and mass marketing is where the risk lives.
A business agrees to use the sending only for its own genuine bookings and customers, never for purchased or scraped lists, and not to alter the messages so they become promotional. We may suspend sending immediately if we reasonably believe it is being misused. The business is responsible for the content of anything it sends through the product and for having the right to contact the people it contacts.
5The policy templates, and why they are not advice
We are not lawyers, and Bookingwell is not legal advice. The consent forms, intake questions and privacy wording the product ships with are a sensible starting point, not a finished policy for any particular business.
A business is responsible for reading these templates, changing them to fit what it actually does, and, where its profession or its risk calls for it, having them checked by its own lawyer or its professional body. We keep them accurate to the product and to the general law we know, and we update them, but they cannot account for a specific business's circumstances and are not a substitute for advice about them.
6Payments
When a business takes payment through Bookingwell, it does so on its own Stripe account and is the merchant of record for those transactions. Card details are entered on Stripe's own page and never reach Bookingwell. Stripe's terms apply to the money, and the fees Stripe charges are between the business and Stripe.
7What we warrant, and what we do not
We warrant that we build Bookingwell with reasonable skill and care, and that it does what these pages and the pricing page say it does at the time of the build. We support and maintain it for any business on a care plan.
Beyond that, and to the extent the law allows, Bookingwell is provided as it is. We do not warrant that it will be free of every fault or never interrupted, and much of it depends on services we do not control: Cloudflare's hosting, an email provider's delivery, Stripe's payments, and a business's own Google account and its own website. We are not responsible for an outage, a change or a failure at one of those providers, though we will act reasonably to work around it. Email in particular is best effort: a booking is confirmed in the product the moment it is made, so a message that fails to send is a follow-up, not a lost booking.
8Limits
Nothing in these terms limits anything that cannot be limited by law, including our own duties for privacy and security described on the other two pages. Subject to that, our total liability to a business for anything arising out of Bookingwell is limited to what the business paid us for the build and, if it is on one, the care plan fees for the twelve months before the claim. We are not liable for indirect or consequential loss, or for lost profits or lost business, and a business is responsible for the content it publishes and the messages it sends and will cover us against a claim that arises from those.
9Stopping, and taking your data with you
A business can stop a care plan whenever it likes and keep its booking page. A business can also close its account, and before it does it can download everything Bookingwell holds for it, so it leaves with its own records intact. When an account is closed, its data is removed as described in the privacy page.
10Reaching us
These terms are governed by the law of Alberta, Canada. For anything about them, write to Synura AI Solutions at hello@synura.ai. If the date at the top changes, the terms have changed, and continuing to use Bookingwell after that means the new ones apply.
